By accessing or using the Site, requesting a quote, booking Services, or otherwise engaging with us, you agree to be bound by these Terms. If you do not agree, do not use the Site or book our Services.
1. Use of the Website
You may use the Site for lawful purposes only. You agree not to:
• Copy, reproduce, modify, distribute, or create derivative works from any content without our written permission.
• Interfere with the Site’s operation or security.
• Use the Site to transmit viruses, spam, or harmful code.
We reserve the right to modify, suspend, or discontinue any part of the Site at any time without notice.
2. Services
Our Services include professional drone aerial photography/videography (FAA Part 107 compliant), ground real estate photography, video editing, and related offerings. Services are custom and performed on-site at your specified location/property.
• All Services are subject to weather, FAA regulations, airspace restrictions, property access, safety conditions, and other factors beyond our control. We will make reasonable efforts to complete Services as scheduled but reserve the right to reschedule or cancel if conditions are unsafe or unsuitable.
• You must provide safe access to the property, ensure it is prepared (e.g., clean, staged, unoccupied if required), and obtain any necessary permissions (e.g., from HOA, neighbors, or property management).
• We are not responsible for delays, reshoots, or additional fees caused by your failure to prepare the site or provide access.
3. Bookings, Payments, and Cancellations
• A booking is confirmed upon receipt of payment (or deposit) and our acceptance.
• Pricing, packages, and payment terms are as stated on the Site or in your quote/invoice.
• All payments are non-refundable except as outlined in our Refund Policy (incorporated herein by reference).
• Cancellations and rescheduling follow the terms in our Refund Policy.
4. Deliverables and Intellectual Property
• Upon full payment, we grant you a non-exclusive, non-transferable license to use the final delivered photos, videos, and other materials (“Deliverables”) for the agreed purpose (e.g., real estate listing, personal use, marketing of the specific property).
• We retain full copyright and ownership of all Deliverables. You may not resell, sublicense, or use the Deliverables for other projects without our written permission.
• We may use non-identifiable portions of Deliverables in our portfolio, website, or marketing unless you request otherwise in writing before delivery.
• Delivery is typically via online gallery/link within 24-48 hours (or as agreed). Files are your responsibility to download and back up.
5. Representations and Warranties
You represent that:
• You have authority to book Services for the property.
• The property location allows safe, legal drone operations (no restricted airspace without proper authorization).
We warrant Services will be performed professionally per industry standards. No other warranties are made, express or implied.
6. Limitation of Liability
To the fullest extent permitted by law, Skyline Drone & Photography LLC, its owners, and contractors shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the Services or Site use. Our total liability shall not exceed the amount paid for the specific Services in question.
We are not liable for:
• Delays or inability to perform due to weather, FAA restrictions, safety issues, or third-party actions.
• Property damage, personal injury, or other claims arising from drone operations (you assume risk for property access and conditions).
• Loss or corruption of files after delivery.
7. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, misuse of Deliverables, or property-related issues (e.g., unauthorized access, privacy complaints from third parties).
8. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Santa Rosa County or Escambia County, Florida (near Pace area). You waive any objection to venue or inconvenience of forum.
9. Changes to Terms
We may update these Terms from time to time. Changes will be posted here with an updated date. Continued use of the Site or Services after changes constitutes acceptance.
